Northern Insurance Co. of New York v. Allied Mutual Insurance
Co.
955 F. 2d 1353 (9th Cir. 1992)
A Mr. and Mrs. Howard sued the makers of California Cooler,
alleging that the mother's use of that drink had caused her child to be
born with FAS. After two years of litigation, the Howards voluntarily
dropped their lawsuit.
This case involved a dispute among the insurance companies and
others regarding who was responsible for the costs of defending the
manufacturer during the two years of litigation.
