Nike and CGT DisputeControversia entre Nike y CGT

In January of 2009, two apparel factories in Honduras, VisionTex and Hugger, declared bankruptcy and closed for business after receiving news that Nike Inc. would no longer be placing orders with them. Each factory’s employees were terminated without severance or back-pay owed to them under Honduran law. The question of who was responsible for providing owed compensation to the terminated workers was a matter of fierce dispute. Honduran labor union Central General de Trabajadores (CGT) maintained that because the factories had declared bankruptcy then Nike, as the global brand at the apex of the supply chain, was financially liable. Nike adamantly denied legal responsibility, declaring that domestic and international attention should be directed towards the owners of the subcontracted factories. However, despite demonstrating significant resolve on this issue, in July 2010 Nike nevertheless announced that it had set aside a compensation and priority rehiring package for the terminated employees amounting to almost $2 million.

Russell and the JHF DisputeControversia de Russell y el JFH

In 2008, the WRC found that the Russell Corporation committed worker’s rights violations when it decided to close its Jerzees de Honduras factory. The WRC found that the main motivation for the closing was a budding pro-union culture that did not please the corporation. After receiving pressure from University partners and monitoring organizations, the Russell Corporation agreed on a solution to remedy the violations on November 14, 2009. The agreement promised that Russell would immediately recognize the workers’ union, contribute to a worker’s welfare fund, phase out the current collective bargaining pact, and re-hire the 1200 workers fired because of union affiliation, at the new Jerzees Nuevo Dia factory. In May of 2011, the company agreed on a new collective bargaining agreement with the union from the Jerzees Nuevo Dia factory that institutes a 19.5 percent wage increase, investment in new machinery, and an expansion of 250 workers. This is a critical step toward implementing the promises that Russell made in the November 2009 agreement.

Estofel Factory Closure Dispute Controversia del Cierre de la Fábrica Estofel

Gear for Sports Inc., a University of Washington licensee, was producing Champion products in its Estofel factory in Guatemala. In October and November of 2007, the Estofel factory was closed, but full severance was denied to the terminated workers. University of Washington students, along with former factory workers, notified the Fair Labor Association of the labor dispute. The FLA and the Workers’ Rights Consortium formally notified Estofel’s parent company, Ghim Li, that further payments were due to the terminated employees. The University of Washington, the FLA and the WRC worked together to hire a third party investigator, COVERCO, to initiate an investigation into the unpaid severance. In February 2009, Ghim Li reached an agreement with COVERCO, the WRC and FLA and partial severance was awarded.

Gear for Sports, un titular de la licencia de la Universidad de Washington, estaba produciendo productos de Champion en su fábrica Estofel en Guatemala.
